NOTICE IS HEREBY GIVEN by the Board of Supervisors of Rush Township that:  a public hearing shall be held with respect to an Ordinance for comprehensive zoning on August 4, 2016, at 6:00 p.m., at the Rush Township Municipal Building located at 338 Reiners School Road, Tower City, Pennsylvania; and, consideration and adoption of the Ordinance for comprehensive zoning is intended at their regularly scheduled meeting on August 4, 2016, at 7:00 p.m., also at the Rush Township Municipal Building. The title and summary of the Ordinance is as follows:

ORDINANCE  NO. 2016-01

AN ORDINANCE OF RUSH TOWNSHIP, DAUPHIN COUNTY, PENNSYLVANIA, PROVIDING COMPREHENSIVE ZONING FOR: (1) DIVIDING OF RUSH TOWNSHIP, DAUPHIN COUNTY, PENNSYLVANIA, INTO DISTRICTS WITH VARYING REGULATIONS; (2) PERMITTING, PROHIBITING, REGULATING AND DETERMINING THE USES OF LAND, SIZE, HEIGHT, DESIGN, LOCATION, ERECTION, CONSTRUCTION, EXPANSION, REMOVAL AND USE OF STRUCTURES, THE AREAS AND DIMENSIONS OF LAND TO BE OCCUPIED BY USES OF STRUCTURES, AS WELL AS YARDS AND OTHER OPEN AREAS TO BE LEFT UNOCCUPIED; (3) ESTABLISHING MAXIMUM DENSITY AND INTENSITY OF USES; (4) PROVIDING FOR ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE IN ACCORDANCE WITH THE PENNSYLVANIA MUNICIPALITIES PLANNING CODE, INCLUDING PROVISIONS FOR SPECIAL EXCEPTIONS, VARIANCES AND APPEALS TO BE ADMINISTERED BY A ZONING HEARING BOARD AND CONDITIONAL USES OBTAINED FROM THE BOARD OF SUPERVISORS; AND (5) ESTABLISHING PROVISIONS FOR THE PROTECTION OF NATURAL FEATURES.

Section 1 of the Ordinance adopts in its entirety a comprehensive Zoning Ordinance of Rush Township, hereinafter “Zoning Ordinance” as follows: 

Article 1.  “Authority, Title, Purpose of Enactment, Interpretation, Applicability, Municipality Liability, Disclaimer, Severability, and Repealer provides for authority to enact the ordinance and its reference title, community and development objectives, public, health, safety and welfare purposes for enactment, interpretation and application of the ordinance, property, structures and uses to which it applies, implementation consistent with existing statutes, and severability of provisions upon determination of invalidity by a court of competent jurisdiction.

Article 2.  “Definitions” provides for the defining of terms utilized in the Ordinance.

Article 3.  “Administration and Enforcement” provides for applicability of the Zoning Ordinance throughout the Township, administration, permits and certificates, certificates of use and occupancy, zoning permits for temporary uses and structures, types of uses, application,  issuance, revocation and appeal of permits or approvals, compliance with County/Municipal Subdivision and Land Development Ordinances, general procedure for permits, interpretations and uses not regulated, interpretation of zoning boundaries, enforcement, violations and penalties, fees, amendments, curative amendments, provisions for a Zoning Officer and Zoning Hearing Board, Zoning Hearing Board functions, actions, variances, special exceptions, appeals, and conditional uses.

Article 4.  “General Regulations” provides regulations applying to all uses for access drives, accessory buildings or structures, antennas, bus shelters, buffer regulations, clear sight triangles, common open space, composts, driveways, dumpster screening, fences and walls, frontage onto improved streets, garage and yard sales, habitable floor area, height regulations, landscaping, manure storage facilities, natural or man-made lakes, dams, ponds and impoundments, number of principal uses and buildings per lot, ornamental ponds and wading pools, parking and storage of unlicensed or uninspected motor vehicles, performance standards, keeping of pets, prohibited uses, recreation courts, rinks and athletic facilities, personal motor vehicle repair, personal vehicle sale, satellite dish antennas, shopping cart storage, outdoor stockpiling, storage and display, temporary and other unenclosed storage, swimming pools, waste and sewage disposal, waste handling, yard adjustment regulations and signs.

Article 5.  “Non-Conforming Lots, Uses and Buildings” provides for the continuation, registration, change, abandonment and discontinuance of existing non-conforming lots of record, uses and buildings. 

Article 6.  “Designation of Zoning Districts, Adoption of Zoning Map and Permitted Use Tables” provides for the division of Rush Township into Zoning Districts, a zoning map, district boundaries and interpretation of boundaries, application of regulations and types of use tables.

Articles 7 through 10, inclusive, provide respectively for Conservation, Agriculture, Residential and Commercial/Industrial Zoning District purposes, uses permitted by right, conditional use or special exception, area and design requirements, sliding scale for single-family detached dwellings, woodland preservation requirements, agricultural nuisance disclaimer, required erosion and sediment pollution control plans, and compliance with Article 4 general provisions.

Article 11.  “Airport District Overlay” provides for the purposes thereof in relation to other Zone Districts, defines terms, establishes airport zones, provides for permit application requirements, variance requirements, use restrictions, pre-existing non-conforming uses, obstruction marking and lighting, violations and penalties, appeals, conflicting regulations and severability of provisions.

Article 12.  “Specific Criteria for Special Exceptions, Conditional Uses and Uses Permitted by Right” provides regulations establishing standards in addition to Article 4 specific to principle and accessory uses in designated zoning districts that shall be applied to each individual special exception, conditional use or use by right.

Article 13.  “Off-Street Parking and Loading Regulations” provides general parking regulations, off-street parking requirements, location of parking spaces, joint parking facilities, design standards, drainage, surfacing and maintenance standards, lighting, loading and unloading spaces, and fire lanes. 

Article 14.  “Adoption of the Ordinance” specifies the effective date of the ordinance upon enactment.

Section 2 of the Ordinance provides for severability of Ordinance provisions upon invalidity, illegality and unconstitutionality thereof. 

Section 3 repeals the existing ordinances conflicting with this Zoning Ordinance.

Section 5 provides for the Ordinance to become effective immediately upon its adoption.
